Welcome to Balkan Style! The terms “we”, “us” and “our” refer to Balkan Style. Balkan Style operates this shop and website, including all information, content, functions, tools, products and services made available to you, the customer, to provide a curated shopping experience (the “Services”). Balkan Style is powered by Shopify, which allows us to provide the Services to you.
The following terms and conditions, as well as all policies mentioned herein (these “General Terms and Conditions” or “Terms”), describe your rights and obligations when using the Services.
Please read these General Terms and Conditions carefully, as they contain important information about your legal rights and cover areas such as disclaimers of warranty and limitations of liability.

To use the Services, including to access or browse our online shops or to purchase the products and services offered by us, you may be asked for certain information, such as your email address, billing, payment and shipping information. You represent that all information you provide in our shops is accurate, current and complete, and that you have all necessary rights to provide such information.

We have made every effort to display our products and services in our online shops as accurately as possible. Please note, however, that the colors or appearance of the products may differ from their depiction on your screen, depending on the type of device you use to access the shop as well as your device settings and configuration.
We make no warranty that the appearance or quality of the products or services you purchase will meet your expectations or match the images or representations in our online shops.
All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and to limit the quantities of products that we offer to any person, geographic region or jurisdiction on a case-by-case basis.
SECTION 3 – ORDERS
When you place an order, you are submitting an offer to purchase. Balkan Style reserves the right, at its sole discretion, to accept or decline your order for any reason. Your order is not accepted until Balkan Style confirms its acceptance. We must receive and process your payment before your order can be accepted. Please review your order carefully before submitting it, as Balkan Style may not be able to process cancellation requests once the order has been accepted. If we do not accept an order, or if we modify or cancel it, we will attempt to notify you via the email address, billing address and/or phone number provided at the time of ordering.
Returns or exchanges of your purchases are exclusively subject to the provisions of our Right of Withdrawal policy https://balkan-style.com/policies/refund-policy.
You represent and warrant that your purchases are for your personal or household use and not for commercial resale or export.
SECTION 4 – PRICING AND BILLING
Prices, discounts and promotions are subject to change without prior notice. The price charged for a product or service is the price in effect at the time the order is placed and will be listed in your order confirmation email. Unless explicitly stated otherwise, the prices quoted do not include taxes, shipping costs, processing fees, customs duties or import fees. In accordance with § 6 Para. 1 No. 27 of the Austrian Value Added Tax Act (UStG), no VAT is charged (small business regulation).
We may offer promotions in connection with our Services from time to time that may affect pricing and are subject to separate terms and conditions. In the event of a conflict between the terms of a promotion and these Terms, the terms of the promotion shall prevail.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made in our shops. You agree to promptly update your account information and other data, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card information you provide is true, correct and complete, (ii) you are duly authorized to use this credit card for the purchase, (iii) the charges incurred by you will be honored by your credit card company, and (iv) you will pay the charges incurred by you at the stated prices, including shipping and processing fees and any applicable taxes.
SECTION 5 – SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We assume no responsibility for delays caused by shipping carriers, customs clearance or events beyond our control. Once we have handed the goods over to the shipping carrier, ownership and the risk of loss pass to you.
SECTION 6 – INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, advertisements, images, graphics, product reviews, videos and audio files, as well as their design, selection and arrangement, are the property of Balkan Style, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.
These Terms permit you to use the Services solely for your personal, non-commercial use. You may not reproduce, distribute, modify, publicly display, publicly perform, republish, download, store, transmit or create derivative works from any of the materials on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants you a license or other rights under any patent, trademark, copyright or other intellectual property of Balkan Style, Shopify or any third party, or may be construed as granting such a license or right. Unauthorized use of the Services may constitute a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Balkan Style.
The names, logos, product and service names, designs and slogans of Balkan Style are trademarks of Balkan Style or its affiliates or licensors. You may not use these marks without the prior written permission of Balkan Style. The name, logo, product and service names, designs and slogans of Shopify are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are trademarks of their respective owners.
SECTION 7 – OPTIONAL TOOLS
You may be given access to customer tools offered by third parties as part of the Services. We do not monitor these tools and have no control or influence over them.
You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the website is entirely at your own risk and discretion. You should therefore familiarize yourself with and agree to the terms and conditions of the relevant third-party tools.
We may also offer new features via the Services in the future (including the release of new tools and resources). Such new features shall also be considered part of the Services and subject to these General Terms and Conditions.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
Balkan Style is powered by Shopify, which allows us to provide the Services to you. However, all sales and purchases you make in our shop are made directly with Balkan Style. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Balkan Style, including any breaches, damages or losses arising from the purchase of products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising out of or in connection with your purchases and transactions with Balkan Style.
SECTION 10 – PRIVACY POLICY

Furthermore, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that affects the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or otherwise exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the Services; (e) use any robot, spider, scraping tool, data gathering or extraction tool, automatic device or process, AI tool (e.g., agentic AI), or any automated or manual means to access the Services; or (f) interfere with, bypass or circumvent the security or authorization features, robot exclusion header or other measures we use to restrict access to the Services. We reserve the right to suspend, disable or terminate your account at any time without notice if we determine that you have violated any part of these Terms.

We may terminate this agreement or your access to the Services (or any part thereof) at our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections shall survive any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions which by their nature should survive termination.

You agree to indemnify, defend, and hold harmless Balkan Style, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, payable to third parties due to or arising out of (1) your breach of these Terms and Conditions or the documents incorporated herein by reference, (2) your violation of any applicable law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that your failure to receive such notice shall not relieve you of your obligations, except to the extent that you are materially prejudiced. We may control the defense and settlement of any such claim at your expense, including the selection of counsel, but will not settle any claim that imposes non-monetary obligations on you without your consent (which shall not be unreasonably withheld). You will cooperate with the defense of any indemnification claim, including by providing relevant documents.

They supersede any prior or contemporaneous agreements, communications, and proposals between you and us, whether oral or written (including, but not limited to, any prior versions of the Terms and Conditions).

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the jurisdiction of the federal, state, or territorial courts located at the seat of Balkan Style. You and Balkan Style consent to the local and personal jurisdiction of these courts.
